“Analysis having been carried out and the existence of doping traces having been proven, the athlete faces a sentence of one to two years. In such cases, there may be intent or fault or negligence. In the former case, the sentence can be up to four years of disqualification, in the latter, as required for Sinner, it ranges from one to two years. “

Why, however, if the ITIA had acquitted Sinner, did Wada appeal? Lawyer Cascella further explains, “Because the rule provides that it is forbidden to find, within the analyses to which an athlete is subjected, substances included in the list of prohibited ones. If prohibited substances are found in the blood or urine analysis of which the athlete and staff are fully aware, in this case the responsibility of the athlete is triggered. Indeed, the same is responsible for the substances that are found in his body, and in Sinner’s case, some of them were detected in the checks conducted on March 10 and 18, 2024. The athlete would have had the right to conduct counter-analyses, however, he preferred not to request them and for this reason he was automatically suspended.” The situation, therefore, is all to be determined.
